2. ACCEPTANCE OF TERMS

By using this Website, you confirm that:

2. The information provided by you is true, accurate and complete;
3. You will use the Website only for lawful purposes;
4. You will comply with these Terms and all applicable laws;
5. You will not misuse the Website or its services; and
6. You understand that property information displayed on the Website may be supplied by third parties.

If you are accessing the Website on behalf of a company, organisation or other legal entity, you represent that you have authority to bind that entity to these Terms.

3. NATURE OF THE WEBSITE

Konkan Property Expo is primarily a property information, advertising, marketing and lead-generation platform.

Property listings, advertisements, photographs, videos, maps, descriptions, prices, dimensions, location information, legal-document information and other property-related material may be provided by property owners, agents, developers, channel partners or other third parties.

5. NO GUARANTEE OF TITLE OR LEGAL STATUS

KPE does not, unless expressly agreed in writing, provide a legal opinion or guarantee regarding:

Clear title, Ownership, Encumbrances, Litigation, Mutation entries, 7/12 extracts, 8A extracts, Ferfar, Property cards, N.A. permissions, Zoning, Development permissions, Building permissions, Sanctioned plans, RERA registration, CRZ restrictions, Forest restrictions, Road reservations, Government acquisition, Access rights, Right of way, Water rights, Electricity permissions, Tax liabilities, Succession claims, Family disputes, Court cases, or Any other legal status of a property.

Where documents are displayed as “verified”, “available”, “submitted”, “checked” or similar terminology, users should understand the precise scope of that verification and should obtain independent professional/legal verification before completing a transaction.

6. RERA COMPLIANCE

Where a property or real-estate project is governed by the Real Estate (Regulation and Development) Act, 2016 (“RERA”), the relevant promoter, developer and/or real-estate agent shall remain responsible for complying with applicable RERA requirements.

RERA provides for registration of real-estate projects and real-estate agents and contains provisions concerning functions and duties of agents and the accuracy of advertisements/prospectuses.

Where applicable, users should independently verify:

• Approved plans, Project status, Possession information & Disclosures
• Details available on the relevant State RERA authority website

KPE shall not be responsible for any false, incomplete or outdated information supplied by a property promoter, owner, agent or other third party.

7. ADVERTISEMENTS

Property advertisements published on the Website may be submitted by property owners, developers, promoters, real-estate agents, Channel Partners, marketing representatives, or other authorised advertisers.

The advertiser is responsible for ensuring that all information supplied to KPE is Accurate, Complete, Current, Lawful, Non-misleading, and Compliant with applicable laws. The Consumer Protection Act, 2019 applies to online transactions and addresses false or misleading advertisements.

KPE reserves the right to reject, modify, suspend or remove any advertisement that it believes may violate applicable law, these Terms, platform policies or the interests of users.

8. PROPERTY PRICES

Property prices displayed on the Website are provided for information and marketing purposes and may change at any time. Unless expressly stated otherwise, a displayed property price shall not constitute a binding offer by KPE.

The final price may depend upon seller/developer negotiation, availability, area measurement, government charges, stamp duty, registration charges, taxes, brokerage, development charges, and documentation charges. Users must confirm final commercial terms directly with the relevant seller/promoter/agent before making payment.

9. PROPERTY AVAILABILITY

Property availability may change without notice. A property may be sold, booked, under negotiation, withdrawn, temporarily unavailable, subject to another transaction, or advertised incorrectly by a third party. KPE does not guarantee continuous availability of any property.

10. PHOTOGRAPHS, VIDEOS AND VISUAL REPRESENTATIONS

Photographs, videos, drone footage, 360° images, maps, illustrations and other visual material are intended to provide general information. Actual property conditions may differ because of camera angle, lighting, weather, editing, landscaping, construction changes, lens distortion, digital enhancement, or changes occurring after recording.

Users should personally inspect the property before entering into a transaction.

11. GOOGLE MAPS AND LOCATION INFORMATION

Location information, map links and distances are provided for convenience. KPE does not guarantee that a mapped location is exact, road access is legally available, the shown route is a legal right of way, distances are exact, infrastructure will remain unchanged, or property boundaries correspond exactly to any digital map. Users should independently verify physical location and access rights.

12. USER REGISTRATION

Certain services may require registration. Users agree to provide accurate and current information. You are responsible for maintaining the confidentiality of your Username, Password, OTP, Login credentials, and Account information.

You must immediately notify KPE if you suspect unauthorised use of your account. KPE may suspend or terminate an account if information is false, misleading, fraudulent or violates these Terms.

13. USER-SUBMITTED CONTENT

Users, advertisers and property owners may submit property photographs, videos, descriptions, documents, contact info, details, reviews, testimonials, and advertisements (“User Content”).

By submitting User Content, you represent that:

1. You have the legal right to submit it;
2. It does not infringe any third-party rights;
3. It is not fraudulent or misleading;
4. It does not violate applicable law;
5. It does not contain unlawful or defamatory material; and
6. You have obtained all necessary permissions from persons appearing in photographs/videos where required.

You grant KPE a non-exclusive, royalty-free, worldwide licence to host, reproduce, display, distribute, modify for formatting, promote and publish such content for operating and marketing the Website and KPE services, subject to applicable law and privacy practices.

14. PROHIBITED CONTENT

Users must not submit content that is fraudulent, defamatory, obscene or unlawful, infringes copyright/trademarks, violates privacy, contains malware, contains false property claims, misrepresents ownership/legal approvals, contains fraudulent documents, promotes illegal activities, misleads consumers, or violates RERA requirements. KPE may remove such content without prior notice.

15. SUBSCRIPTION / PLATINUM MEMBERSHIP

KPE may offer paid subscription or membership plans, including Platinum Membership or other plans introduced from time to time. The applicable price, duration, benefits, taxes, promotional discounts, coupon codes, eligibility, renewal, and refund conditions shall be displayed on the relevant subscription page or communicated at purchase.

Subscription benefits are subject to the specific plan purchased. KPE reserves the right to modify future plans and benefits. Any change will not retrospectively remove a benefit already expressly promised for the active subscription period, except where required by law.

16. SUBSCRIPTION PAYMENT

Payments may be processed through third-party payment gateways. KPE does not store complete debit-card, credit-card or banking credentials unless specifically permitted by applicable law and payment-provider arrangements. The user agrees to comply with the terms of the relevant payment gateway. In case of payment failure or technical error, the user should contact KPE with appropriate transaction details.

17. REFUND AND CANCELLATION

Unless otherwise expressly stated on the relevant service page, subscription/service fees are generally non-refundable once the service has been activated or delivered.

However, refunds may be considered where:

• The Company is unable to provide the purchased service;
• A duplicate payment has occurred;
• A transaction was successfully charged but the service was not activated due to a technical error; or
• A refund is required under applicable law.

Promotional, discounted or coupon-based purchases may be subject to separate refund conditions. Nothing in this clause shall restrict mandatory consumer rights available under applicable law.

18. ADVERTISING SERVICES

KPE may provide paid property advertising and marketing services (including photography, videography, drone shots, social media, YouTube, Website, WhatsApp, and lead generation).

Payment for advertising does NOT guarantee sale of the property, number of enquiries/leads/views/subscribers, site visits, buyer interest, transaction completion, or a particular sale price.

19. LEADS AND ENQUIRIES

KPE may generate or forward enquiries to property owners, agents, developers or advertisers. A lead or enquiry is not a guarantee of genuine buying intent, financial capability, property purchase, site visit, booking, sale, or commission. KPE does not guarantee any minimum number of leads unless expressly stated in a written service agreement.

20. CHANNEL PARTNER PROGRAM

Where KPE offers a Channel Partner or referral programme, the programme shall be governed by the applicable Channel Partner Agreement, joining terms, commission structure and policies. In case of conflict between these Website Terms and a specific signed Channel Partner Agreement, the signed agreement shall prevail to the extent of the conflict.

21. NO GUARANTEE OF INCOME

Any income figures, earning examples, commission illustrations or success stories appearing on the Website, advertisements or promotional materials are illustrative unless expressly guaranteed in a legally binding written agreement. Past performance or another person's earnings do not guarantee future earnings.

22. THIRD-PARTY SERVICES AND WEBSITES

The Website may contain links to third-party platforms (Google Maps, Payment Gateways, Social Media, RERA, YouTube, WhatsApp). KPE is not responsible for the availability, accuracy, privacy practices, security, content or policies of third-party websites.

23. INTELLECTUAL PROPERTY

All content created or owned by KPE, including logos, brand names, website design, text, graphics, videos, original photographs, marketing material, software, layout, icons, designs, and databases are protected by applicable intellectual-property laws. No person may copy, reproduce, modify, publish, distribute, or commercially exploit KPE content without prior written permission.

24. TRADEMARK

“Konkan Property Expo”, associated logos, slogans, designs and brand identifiers constitute trademarks or proprietary marks of the Company or their respective owners. Unauthorised use is strictly prohibited.

25. COPYRIGHT COMPLAINTS

If you believe content appearing on the Website infringes your copyright or intellectual-property rights, contact KPE with your identity, identification of the protected work, evidence, and statement of accuracy. KPE will investigate and remove disputed content where appropriate.

26. PRIVACY AND PERSONAL DATA

KPE collects and processes information such as Name, Mobile number, Email, Property requirements, Enquiry details, Account & Transaction info in accordance with KPE's Privacy Policy and applicable Indian data-protection laws.

27. COMMUNICATIONS

By submitting contact info or enquiries, you consent to receiving service-related communications via Telephone, SMS, Email, or WhatsApp. Marketing communications shall be handled in accordance with applicable law and user preferences.

28. USER RESPONSIBILITY FOR PROPERTY TRANSACTIONS

Users are solely responsible for conducting appropriate due diligence before paying a token amount, paying an advance, signing an agreement, purchasing land/houses, or entering into development agreements.

We strongly recommend obtaining independent advice from property lawyers, chartered accountants, architects, surveyors, and government authorities.

29. NO PROFESSIONAL LEGAL OR FINANCIAL ADVICE

Information provided by KPE does not constitute Legal, Tax, Financial, Investment, Valuation, or Architectural advice. Users should consult qualified professionals before making significant decisions.

30. USER FRAUD AND MISREPRESENTATION

KPE may suspend, block or terminate any account or listing where there is reasonable suspicion of Fraud, Fake documents, False ownership claims, Duplicate listings, Misleading info, Payment fraud, or Identity fraud. KPE may cooperate with law-enforcement agencies as required.

31. WEBSITE AVAILABILITY

KPE attempts to keep the Website available but does not guarantee uninterrupted or error-free access due to maintenance, server failure, cybersecurity incidents, or force majeure events.

32. CYBERSECURITY AND PROHIBITED TECHNICAL ACTIVITY

Users must not hack the Website, introduce malware, attempt unauthorised access, scrape information unlawfully, conduct denial-of-service attacks, or reverse engineer protected systems. Unauthorised interference may result in legal action.

33. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, KPE shall not be liable for indirect, incidental, consequential, special or punitive losses arising from property transactions, incorrect information, title disputes, financial losses, or third-party acts.

34. INDEMNIFICATION

You agree to indemnify and hold harmless KPE, its owners, directors, employees, and affiliates against claims, losses, liabilities, damages, and costs arising from your breach of these Terms, unlawful use, false information submitted, or property transactions.

35. SUSPENSION OR TERMINATION

KPE may suspend, restrict or terminate access to the Website or a user's account where Terms are violated, fraud is suspected, or payment obligations are not met.

36. CHANGES TO THESE TERMS

KPE may modify these Terms from time to time. The updated Terms will be published on the Website with the revised “Last Updated” date. Continued use constitutes acceptance.

37. FORCE MAJEURE

KPE shall not be responsible for failure or delay caused by circumstances beyond reasonable control (natural disasters, floods, earthquakes, pandemics, cyberattacks, government restrictions, or telecom failures).

38. GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of India. Subject to applicable consumer-protection rights, disputes shall be subject to the exclusive jurisdiction of the competent courts having jurisdiction over Devrukh / Ratnagiri, Maharashtra.

40 - 42. GENERAL LEGAL PROVISIONS

40. Severability: If any provision is found invalid, remaining provisions continue in effect.
41. Waiver: Failure to enforce any provision shall not constitute a waiver.
42. Entire Agreement: These Terms, together with Privacy Policy, Refund Policy, and Channel Partner Agreements, constitute the entire agreement between the user and KPE.
